More for your heirs, less for the tax man.
It is perfectly possible to bequeath something under Flemish law to Brugge Foundation without disadvantaging your legal heirs. A dual legacy is a very good way to do that and the principle is simple.
 
As the name suggests, a dual legacy comprises two linked legacies. You leave a lump sum or a specific property to an heir and another lump sum or property to Brugge Foundation. As well as the inheritance tax on the legacy to Brugge Foundation, Brugge Foundation also pays the inheritance tax on your legacy to your heirs. These heirs will therefore pay no inheritance tax. So including Brugge Foundation in your will can be advantageous for your heirs, as they will be left with a higher net amount.
 
In the event of an ‘exclusive’ legacy to Brugge Foundation the inheritance tax depends on the tax residence status of the legator at the time of his or her death. This is because the law is different in the three regions of Belgium. If you leave something to charity in Flanders you always benefit from a reduced rate of 8.5%. This reduced tax rate ensures that the majority of your estate benefits Brugge Foundation.
